Terms of Service

1. Agreement to Terms

By accessing or using WifiFee ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

WifiFee provides a platform for venue operators to monetize their guest WiFi networks through customizable captive portals and payment processing. The Service integrates with TP-Link Omada controllers and Stripe for payment processing.

3. User Accounts

Account Registration

To use the Service as a venue operator, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials.

Account Responsibilities

  • You are responsible for all activity under your account
  • You must have legal authority to operate your venue's WiFi network
  • You must comply with all applicable laws regarding WiFi access and data collection
  • You must notify us immediately of any unauthorized account access

4. Fees and Payment

Platform Fee

WifiFee charges a platform fee of 10% on each guest payment processed through the Service. This fee is automatically deducted before funds are transferred to your Stripe account.

Stripe Fees

Standard Stripe payment processing fees apply and are separate from our platform fee. See Stripe's pricing at stripe.com/pricing.

Payouts

Payments are processed through Stripe Connect. Payout timing depends on your Stripe account settings and country.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to systems or networks
  • Transmit malware or harmful code
  • Collect guest data beyond what is necessary for WiFi access
  • Use the Service to discriminate against guests
  • Resell or redistribute the Service without authorization

6. WiFi Guest Terms

As a venue operator, you are responsible for ensuring your guests understand:

  • The terms of WiFi access at your venue
  • Any acceptable use policies for your network
  • How their data is collected and used

WifiFee is not responsible for disputes between venues and their guests regarding WiFi access or service quality.

7. Refunds

Venue operators may issue refunds to guests through the WifiFee dashboard. Refunds are processed through Stripe and returned to the guest's original payment method. WifiFee's platform fee is refunded when you issue a refund.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on:

  • Your Omada controller being accessible and properly configured
  • Stripe's payment processing availability
  • Your venue's network infrastructure

We are not liable for downtime caused by factors outside our control.

9. Intellectual Property

The Service, including its design, features, and content, is owned by WifiFee. You retain ownership of your business data, pricing configurations, and branding elements uploaded to the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIFIFEE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim related to the Service shall not exceed the platform fees you paid in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless WifiFee from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

Either party may terminate this agreement at any time:

  • You: Delete your account through the settings page
  • Us: We may suspend or terminate accounts that violate these Terms

Upon termination, your access to the Service will cease. Pending payouts will be processed according to Stripe's policies.

13. Changes to Terms

We may modify these Terms at any time. We will notify account holders of significant changes via email. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction where WifiFee is registered, without regard to conflict of law principles.
